New online gambling tax in Peru to start at lower rate during transition period

Peruvian President Dina Boluarte has approved a new tax on online gambling and sports betting. The details, published in the Official Gazette, confirm the introduction of a Selective Consumption Tax.

Initially, the tax rate will be set at 0.3 per cent and will increase to 1 per cent from 1 July 2025. The tax applies to online gaming transactions by Peruvian citizens or residents.

Operators had anticipated an immediate implementation of the 1 per cent rate. However, they raised concerns about the time required to adapt their platforms and gain recertification from Mincetur, Peru’s national regulator. They argued that the sudden increase could not be absorbed quickly and might impact players.

In response, President Boluarte and Finance Minister José Arista Arbildo agreed to a six-month transition period. This adjustment gives operators more time to comply with the new rules while easing the impact on the industry.

Despite the changes, some operators believe the tax could harm the regulated market. They warn that higher costs may push players toward unlicensed platforms, reducing channelisation to the legal market.

In addition to the Selective Consumption Tax, Congress has already approved Bill-2070/2021. This legislation introduces a 10 per cent tax on gross gaming revenue for online casinos and sports betting.

The Selective Consumption Tax will come into effect on 1 January 2025. MINCETUR will oversee its implementation. They will track transactions using Peruvian IP addresses, bank accounts, credit cards, or local SIM cards to enforce compliance.
